Respecting the privacy of the users of our websites, we operate a Privacy Policy.

Privacy Policy

This Privacy Protection Policy sets out the principles for the processing and protection of personal data collected from Users during their use of the planetfan.pl website, operating at the internet address www.planetfan.pl, (hereinafter referred to as the “Service”), provided by Planetfan sp. z o.o. with its registered office in Imielin, ul. Rzemieślnicza 8, registered in Poland with NIP number 646-28-75-351 REGON 241443713 KRS 0000346139 District Court Katowice Wschód in Katowice, VIII Economic Department of the National Court Register.

“User” within the meaning of the Privacy Policy means a natural person using the Website.

By using the Website, the User agrees to the terms and conditions described in this Privacy Policy.

Personal Data

In accordance with the contents of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data (the “Regulation”) Planetfan sp. z o.o. sp. k. with its registered office in Imielin at ul. Przemysłowa 5, registered in Poland with Tax Identification Number (NIP) 646-28-75-351 REGON 241443713 KRS 0000346139 District Court Katowice Wschód in Katowice, 8th Economic Division of the National Court Register (referred to in the Privacy Policy as “PLANETFAN”), informs that it is the administrator of the personal data provided by the User in connection with or during the use of the Website. Personal data are processed in accordance with the Regulation and, where required by its content, with the User’s consent.

PLANETFAN collects only data that is necessary to conclude an agreement and provide a service selected by the User, to answer questions addressed to PLANETFAN, to market its own services and to provide information on its offer.

When registering or ordering a service, PLANETFAN collects the data provided by the User in the forms provided. This data includes:

surname and first name,

e-mail address,

address of residence or registered office,

mailing address,

telephone number.

Where required by the Regulation, the User’s consent to the processing of his/her personal data is given electronically, by ticking the appropriate box during registration or any other procedure aimed at enabling the use of the Website. The User may revoke consent to the processing of personal data at any time.

The provision of data marked as required on the Website is voluntary, but necessary in order to conclude an agreement and provide a service to the User or to register the User on the Website. If the User fails to provide the required personal data, it will not be possible to register the User on the Website or to conclude an agreement and perform a service for the User.

The basis for PLANETFAN’s processing of the personal data provided by the User is the need to perform an agreement and, at the request of the User, to take necessary actions prior to its conclusion (Article 6(1)(b) of the Regulation). In the case of marketing PLANETFAN’s own services and sending information about its offerings to the email address provided by the User, the basis for processing the User’s personal data is the realisation of PLANETFAN’s legitimate interest (Article 6(1)(f) of the Regulation). The processing of data for the purpose of PLANETFAN’s provision of information on its products and services enables PLANETFAN to provide the User with information on its current offerings. In the case of Newsletter service provided to the User, the basis for data processing is the User’s consent (Article 6(1)(b) of the Regulation), which may be revoked by the User at any time.

The User’s personal data will be stored in a form which allows the User to be identified for no longer than is necessary for the purposes for which the personal data are collected and lawfully processed. Personal data will therefore be stored for the period necessary for the performance of the contract and the provision of the service chosen by the User. Thereafter, the data will be processed for the period necessary to resolve any potential disputes that may arise in connection with the services provided, e.g. related to claims (this period will include the limitation period for contractual claims, in accordance with the applicable legislation).

Entrusting personal data

The processing of User’s personal data or other data referred to in the Privacy Policy may be entrusted on the basis of a written agreement concluded in accordance with the provisions of the Regulation to entities providing PLANETFAN with services such as hosting, administration, maintenance and management of the Website.

PLANETFAN entrusts the processing of User’s personal data or other data referred to in the Privacy Policy to other entities providing services directly to PLANETFAN to the extent necessary for the execution of orders made through the Service, on the basis of a written agreement concluded in accordance with the Ordinance.

Subject to the above provisions, collected personal data shall not be disclosed to any other persons or institutions unless required by applicable law or necessary for the purpose of personal data processing and an appropriate agreement guaranteeing protection of the User’s rights and privacy is concluded.

Rights and obligations of the User

The User has the right to access the content of the personal data and the right to request completion, updating, portability, restriction of processing, rectification of the personal data, temporary or permanent suspension of their processing or deletion if they are incomplete, outdated, untrue or have been collected in violation of the law or are no longer necessary for the purpose for which they were collected.

If the User’s data are processed for the purpose of marketing the service and the User’s own products, the User may, at any time, make a written and reasoned request to stop the processing of his/her data due to his/her particular situation or object to the processing of his/her data for this purpose.

PLANETFAN shall allow the User to delete his/her personal data from the dataset at the User’s request or pursuant to the provisions of the Regulation.

PLANETFAN may refuse to delete personal data if the User has violated the Service’s rules and regulations or applicable laws and the preservation of personal data is necessary to clarify the circumstances of the violation and to establish the User’s responsibility.

If the User posts any personal data of other persons (including their name, address, telephone number or e-mail address) on the Website, he/she may do so only on condition that the provisions of the applicable law and the personal rights of such persons are not violated.

Additional information about cookies:

Cookies are text files that are stored on the User’s terminal device, which are used to recognise the User’s device when he/she reconnects to a website that uses cookies.

Cookies are not used to establish the User’s identity, but they make it possible to determine more precisely the individual needs of the User using a given device and thus to offer better and more tailored services, as well as to facilitate connection to websites of interest to the User.

Cookies are also used by PLANETFAN for:

statistics – which allows the creation of statistics on the functioning of websites and Users’ visits for internal purposes and contractors,

presentation and personalisation of marketing messages displayed on a given terminal device.

The User may refuse to allow cookies to be placed on their terminal equipment. To do so, use the option to disable the downloading and storage of cookies in the web browser. The method for disabling the downloading and storage of cookies in popular web browsers is provided by the browser provider.

Deleting cookies may result in the loss of the possibility to use some functionalities of PLANETFAN websites.

Other data

In some cases, PLANETFAN collects certain types of information automatically during a User’s visit to the Website or via email addresses. Such usage data related to the use of the Website (IP address and port, browser ID, addresses of pages visited) are stored in aggregate and anonymised form and are not shared with third parties. This data is used to better understand and improve the operation, functionality and performance of the Website and to generate statistics to help administer the Website.

Users’ data are also processed by PLANETFAN for automated processing in the form of profiling. Profiling means any form of automated processing of personal data by PLANETFAN that involves the use of Users’ personal data to assess certain personal factors, in particular to analyse or forecast Users’ preferences, reliability, behaviour, location. Any User has the right to object to profiling by PLANETFAN if he/she considers that profiling infringes his/her rights and freedoms, unless the controller demonstrates that his/her own interest overrides the person’s rights and freedoms. The User may express his/her objection to profiling free of charge in any form through the available channels of communication with PLANETFAN.

Data security

In order to protect the User’s personal data from being made available to unauthorised persons, from being collected by an unauthorised person, from being processed in violation of applicable regulations, and from being altered, lost, damaged or destroyed, technical and organisational measures are applied to ensure the protection of the processed personal data appropriate to the risks and categories of protected data.

In particular, the Administrator shall use technical measures to prevent unauthorised persons from acquiring or modifying the data. The Administrator secures data files from access by unauthorised entities, provides access to the User’s account only after authentication, which involves providing an individual login and password. In addition, data provided by the User when filling in and submitting web forms is encrypted through the use of SSL certificates.

Changing the Privacy Policy

PLANETFAN reserves the right to amend the Privacy Policy and, at the same time, ensures that the User’s rights under this document will not be restricted without his/her consent. Any changes to the Privacy Policy will be published on the website www.planetfan.pl.

Contact with the supervisory authority

In all matters related to the processing of the User’s personal data and the application and implementation of this Privacy Policy, the User has the right to lodge a complaint with the President of the Personal Data Protection Authority.
